CBD in tobacco shops: legality, price, and what to check before buying

Yes, buying CBD in a tobacco shop is legal, under the same conditions as anywhere else: the product must contain less than 0.3% THC. The sale of CBD is not a monopoly held by tobacconists. A tobacco shop, a specialty store, or an online site all follow the same rules. What changes from one counter to the next is the selection, the price per gram, and the information displayed on the product.

Yes. Since the Council of State decision of December 29, 2022, the sale of hemp flowers and leaves containing less than 0.3% THC is authorized in France. This rule applies to all businesses: a tobacconist has no more or fewer rights than a specialty shop or an online site.

CBD is not a tobacco monopoly product. The Confederation of Tobacconists stated this as early as 2020, requesting clear regulation so its network could sell "a non-monopoly product." In practice, a tobacconist chooses their suppliers and prices, like any other merchant.

Two legal points often come up at the counter:

  • "THC-free" CBD. A legal flower contains up to 0.3% THC: that is not zero. These traces can cause a positive saliva test result. Everything is detailed in our CBD and driving guide.

What should no longer be found at the counter

Three families of products should no longer be for sale: disposable puffs, edible CBD products, and anything containing synthetic cannabinoids. If you see them, at a tobacco shop or elsewhere, move on.

  • Disposable puffs, even with CBD. Law no. 2025-175 of February 24, 2025, prohibits the sale of single-use vaping devices (Senate file). It targets the device, not its content: a nicotine-free CBD puff is also covered. Rechargeable vapes remain authorized.
  • Edible CBD. Since May 15, 2026, the DGAL control plan has targeted unauthorized ingestible CBD products like novel foods: candies, gummies, syrups, infusions, capsules, and most oils sold as food supplements. Flowers and resins for smoking or vaporizing, and cosmetics, are not covered. Details are in Edible CBD prohibited since May 15, 2026.
  • Synthetic cannabinoids. HHC has been classified as a narcotic since June 2023 (ANSM), and other derivatives like H4CBD or THCP followed in May 2024 (ANSM). Why we refuse them: hemp derivatives, legality and risks.

The ANSM has reported several hundred cases of poisoning since the start of 2024. They were caused by products sold as CBD but containing synthetic cannabinoids or more than 0.3% THC. These products circulated in stores, vending machines, and online. This is not a problem specific to tobacco shops; vigilance is necessary everywhere.

Flowers, resin, CBD cigarettes: what can be found in tobacco shops

At the counter, you mainly find flowers and resin in small containers, pre-rolled joints, CBD cigarettes in packs, and e-liquids. The selection depends entirely on the tobacconist's supplier: usually a few references, rarely a full range.

  • Flowers and resins. These are the flagship products, often in small quantities. To understand the difference between the two, read CBD flowers or CBD resins: what are the differences?
  • CBD cigarettes and pre-rolled joints. A "CBD cigarette" is generally a hemp flower pre-roll with a filter, sold in a pack. Some brands add nicotine: check the ingredients. Our pre-rolled CBD joints contain only flowers, without tobacco or nicotine.
  • CBD e-liquids. They remain authorized for use in a rechargeable vape.

How much does CBD cost in a tobacco shop?

There is no official price list for CBD in tobacco shops: each tobacconist sets their own, based on their supplier. We cannot give you "the" price for CBD at a tobacco shop. To contextualize, the national reference remains indoor flowers, between €5 and €12 per gram in France according to our CBD price comparison.

The only honest comparison is the price per gram. Divide the price by the weight shown on the label: a 1g jar and a 10g bag cannot be compared otherwise. For a pack of CBD cigarettes, divide the price by the number of cigarettes and look at the stated flower weight. If the label does not state the weight, you cannot compare, and that is already a bad sign.

Five checks before buying

The same five points apply to tobacco shops, CBD specialists, and online. A serious vendor will answer them directly; if they can't, it's a sign.

  1. CBD and THC levels. They must appear on the label, with THC below 0.3%.
  2. A batch number and analysis. The batch number allows you to track back to the laboratory analysis certificate. Don't hesitate to ask for it.
  3. Origin. Country of cultivation or at least provenance: a product without a clear origin has no history.
  4. Composition. No HHC, H4CBD, or THCP. Be wary of promises of an "effect like THC": it is often a sign of a tainted product. And no nicotine if you don't want it.
  5. A closed and labeled product. The Public Health Code governs the labeling of plant-based smoking products (articles L. 3514-1 to L. 3514-6). A bulk product with no label is a bad sign.

Tobacco shop or online: which to choose?

The tobacco shop has the advantage of immediacy: you leave with your product, with no shipping costs. Online, you have more choice, detailed product sheets, and often better prices per gram on larger sizes, but you have to wait for delivery. Both complement each other.
